We process your personal data primarily for purposes related to your use of our website, such as managing a user account, sending newsletters, matters concerning quotation requests, analysis, statistics, marketing, etc. We process your personal data for the period necessary to achieve each specific purpose.

You have the right to access your personal data, to rectify, delete or restrict processing, to object to processing, as well as the right to data portability. In addition, you may lodge a complaint with the President of the Personal Data Protection Office.

1. Who is the personal data controller?

Where we use terms such as "we", "our", etc. in the Privacy Policy, we mean the indicated entity. With regard to social media profiles associated with our website, in accordance with the case law of the Court of Justice of the European Union, we are a joint controller of personal data together with the provider of the social network in which the given profile operates.

2. Who can you contact regarding the processing of personal data?

As part of implementing a personal data protection system in our organization, we have decided not to appoint a data protection officer due to the fact that in our situation this is not mandatory.

For matters related to personal data protection and privacy in general, you can contact us at odo@shiftum.ai. With regard to social media, you can additionally contact directly the administrators of the social networks where we maintain our profiles.

3. For what purposes do we process personal data?

There is more than one purpose. Below is a list of them, along with a more detailed discussion. Each purpose has also been assigned the appropriate legal basis for processing:

User account management

Registration of a user account requires providing the necessary data specified in the registration form.

As part of editing your account data, you can provide your further data, according to the available options within the account. In addition, our system used to manage user accounts saves your IP number from which you registered the user account.

The data is processed in order to provide you with the user account service. After deleting the user account, the data is transferred to the archive for the purposes of possible establishment, pursuit or defense of claims related to the user account service.

Newsletter management

By subscribing to the newsletter, you must provide the data necessary to receive it as specified in the subscription form. Providing data is a condition for receiving the newsletter.

In addition, the mailing system records your IP number from which you subscribed to the newsletter, determines your approximate location, the mail client you use to handle e-mail, and tracks your actions taken in connection with messages sent to you. As a result, we also have information about which messages you opened, in which messages you clicked on links, etc. In the mailing system, we can define, based on various criteria related to your activity, interests or other preferences, specific groups or segments of newsletter recipients that affect what type of messages you receive in the newsletter.

The data you provide in connection with subscribing to the newsletter is used to send you the newsletter, and the legal basis is our legitimate interest, which in this case is the pursuit of marketing purposes. As for the processing of information that does not come from you but has been collected automatically, we rely on our legitimate interest consisting in analyzing the behavior of newsletter subscribers to optimize marketing activities.

At any time you can unsubscribe from the newsletter by clicking on the dedicated link found in each message sent as part of the newsletter, or simply by contacting me.

Unsubscribing from the newsletter does not result in the deletion of your data from the mailing system. The data is transferred to the archive for the purposes of possible establishment, pursuit or defense of claims related to the newsletter, as well as to ensure the ability to demonstrate that newsletter activities were conducted in accordance with the law.

Contact and correspondence handling

By contacting us through available means of communication, e.g. e-mail, social media messengers, you naturally provide your personal data contained in the content of the correspondence.

Providing data is a condition for establishing contact. In addition, the communication system records your IP number from which you sent the message. The data is processed for the purpose of conducting communication, which constitutes our legitimate interest.

After the communication ends, the data is transferred to the archive for the purposes of possible establishment, pursuit or defense of claims related to the conducted communication.

Creating advertising audience groups

Your e-mail address stored in our database may be sent to a specific advertising system (e.g. Facebook Ads, LinkedIn Ads) in order to create an advertising audience group using that e-mail address.

When using this function, the e-mail address is hashed before being sent to the given system to create an audience group. The e-mail address will be used in the matching process conducted by the given advertising system. The advertising system does not share the e-mail address with third parties or other advertisers and deletes the e-mail address immediately after the matching process is completed. T

he advertising system implements processes and procedures ensuring the confidentiality and security of the e-mail address sent to it and the set of user identifiers creating the audience group created using the e-mail address, among others, through the use of technical and physical safeguards. Creating an advertising audience group using your e-mail address constitutes our legitimate interest, which in this case is the pursuit of our marketing purposes.

Social media management

If you follow our profiles on social networks or interact with content published by us on social media, you naturally see your data that is publicly available in your social media profile.

We process this data only within the given social network and only for the purpose of managing the given social network, which constitutes our legitimate interest. If you contact us via private message, you naturally provide us with your personal data contained in the content of the correspondence, in particular your image and name and surname. Your data is in this case processed for the purpose of contacting you, and the basis for processing is our legitimate interest.

It may happen that we will be the party initiating contact with you via social media in order to offer cooperation, in which case your data will be processed for the purpose of searching for potential contractors, offering and establishing cooperation, which is our legitimate interest.

Messages sent to us via social media are automatically archived through tools available within individual social networks and are available to us until you delete them. You have access to all messages exchanged with us in the private messages tab. Your use of social networks is subject to the terms and conditions and privacy policies of the administrators of these services, and these administrators provide you with electronic services fully independently and independently of us.

Analysis and statistics

We conduct analytical and statistical activities using tools provided by external providers. Within analytical tools, we have access only to Anonymous Information. We base the processing of this information on legitimate interest, which consists of creating, reviewing and analyzing statistics related to user activity on the site in order to draw conclusions allowing for the subsequent optimization of our activities.

From the level of the tools, we have access only to a set of statistics and information not assigned to specific individuals. Detailed information about external provider tools can be found in the section dedicated to the tools we use.

Own marketing

We conduct marketing activities using tools provided by external providers. Within marketing tools, we have access only to Anonymous Information. We base the processing of this information on legitimate interest, which consists of conducting marketing activities, including targeting ads within external systems for the marketing of our own products and services.

From the level of the tools, we have access only to a set of statistics and information not assigned to specific individuals. Detailed information about external provider tools can be found in the section dedicated to the tools we use.

Providing additional functions using only Anonymous Information

As a personal data controller, we are obliged to fulfill obligations related to the protection of personal data. In connection with this, we may process your personal data insofar as it is necessary to perform these obligations (e.g. when considering your request regarding your personal data).

The scope of data depends on what data we need to fulfill the obligation and prove compliance with the GDPR. In addition, in this case we also rely on our legitimate interest, which consists in securing data necessary to demonstrate accountability.

Fulfillment of obligations arising from the Digital Services Act (DSA)

As an intermediary service provider, we are obliged to fulfill obligations arising from the Digital Services Act (DSA), such as receiving and processing reports concerning User Content, receiving and processing appeals regarding decisions we have taken in relation to User Content, providing specific information about the user after receiving an order issued by authorized institutions or bodies, and notifying law enforcement authorities or judicial bodies of suspected commission of a crime threatening the life or safety of a person or persons in connection with the use of the service. For these purposes, we process personal data to the extent necessary to fulfill obligations provided by law.

Storage of User Content

By submitting User Content (as defined in our terms and conditions), e.g. a comment or opinion, you must provide the personal data necessary for this purpose. Providing data is a condition for submitting User Content.

In addition, our ICT system records your IP number from which you submitted the User Content. The ICT system handling User Content may be operated by an external provider. In such a situation, the use of the system is subject to the terms and conditions and privacy policy of the external provider. Detailed information about external provider tools can be found in the section dedicated to the tools we use.

The data is processed for the purpose of publishing User Content on the service or storing it in the ICT system related to the service, which constitutes the provision of a service to you electronically in accordance with our terms and conditions. If you submit User Content intended for publication on the service, the User Content you submit, together with the accompanying personal data, is publicly available on the service.

You can modify or delete the submitted User Content at any time. Deleted User Content together with your personal data is transferred to the archive for the purposes of possible establishment, pursuit or defense of claims related to Digital Content and demonstration of accountability.

4. What information about you do we have?

Within each of the purposes described above, we may process a different scope of data - such as is necessary to achieve a specific purpose. Among the data is information such as:

  • name and surname,
  • e-mail address,
  • phone number,
  • IP address,
  • data collected in the mailing system,
  • information visible in social media profiles,
  • information contained in correspondence,
  • information contained in User Content or accompanying User Content,
  • Anonymous Information.

5. What is "Anonymous Information"?

We use tools that collect a range of information about you related to your use of our website. This concerns in particular the following information:

  • information about the operating system and web browser,
  • viewed subpages,
  • time spent on the site,
  • transitions between individual subpages,
  • clicks on individual links,
  • mouse movements,
  • page scrolling,
  • source from which you navigate to the site,
  • age range in which you are,
  • your gender,
  • your approximate location limited to locality,
  • your interests or other preferences determined based on online activity.

This information is referred to in this Privacy Policy as "Anonymous Information".

Anonymous Information in itself does not, in our opinion, constitute personal data, because it does not allow us to identify you and we do not combine it with typical personal data that we collect about you. Nevertheless, taking into account the rigorous case law of the Court of Justice of the European Union and divided opinions among lawyers, out of caution, in case Anonymous Information were to be attributed the nature of personal data, we have also included in the Privacy Policy detailed explanations regarding the processing of this information.

We are not able to provide you with access to Anonymous Information about you, because we are not able to assign any of the Anonymous Information to any specific user. From the level of tools collecting Anonymous Information, we have access only to a set of statistics and information not assigned to specific individuals.

Processing Anonymous Information allows us to provide you with the ability to use the functionalities available on the site. In addition, Anonymous Information is used for analytical and statistical purposes as well as marketing purposes, such as setting and targeting ads.

Anonymous Information is also processed by tool providers on the terms resulting from their terms and conditions and privacy policies. They may be used by these providers to provide and improve services, manage them, develop new services, measure the effectiveness of advertising, protect against fraud and abuse, as well as personalize content and ads displayed in individual services, sites and applications. Detailed information related to this can be found in the section dedicated to the tools we use.

6. Where do we get information about you from?

In most cases, you provide it to us yourself. For example, this happens when you register a user account, subscribe to the newsletter, contact us, and also use the functionalities available on our website or in external services (e.g. social media). In addition, some information about you may be automatically collected by the tools we use. Detailed information about external tools can be found in the appendix to the Privacy Policy.

7. Is the data safe?

We care about the security of your personal data. We have analyzed the risks associated with individual processes of processing your data, and then implemented appropriate security measures and personal data protection. We continuously monitor the state of technical infrastructure, train personnel, review applied procedures, and introduce necessary improvements.

8. How long will we store personal data?

We process your personal data for as long as it is justified within a given purpose of personal data processing, and therefore processing periods differ depending on the purpose. Remember that the termination of processing your data within one purpose does not necessarily have to lead to the complete deletion or destruction of your personal data, because the same set of data may be processed for another purpose, for the period indicated for it. Complete deletion or destruction of data occurs when we complete the implementation of all purposes and in other cases indicated in the GDPR.

9. Who are the recipients of personal data?

We will venture to say that modern business cannot do without services provided by third parties. We also use such services. Some of these services involve the processing of your personal data. External service providers who participate in the processing of your personal data are indicated in the table below.

If such a need arises, your data may be disclosed to a legal counsel or attorney bound by professional secrecy. The need may arise from the necessity to use legal assistance requiring access to your personal data. Your personal data may also be transferred to tax authorities to the extent necessary to fulfill tax-accounting obligations. This concerns in particular all declarations, reports, statements and other accounting documents containing your personal data.

In addition, should such a need arise, your personal data may be disclosed to entities, bodies or institutions entitled to obtain access to data on the basis of legal provisions, such as police services, security services, courts, prosecutor's offices. As for Anonymous Information, providers of tools that collect Anonymous Information have access to it.

Providers of these tools are independent controllers of the data collected in them and may share this data on the terms set out by themselves in their own terms and conditions and privacy policies, over which we have no control. A list of external tools can be found in the appendix to the Privacy Policy.

10. Do we transfer data to third countries or international organizations?

Yes, some personal data processing operations may involve transferring them to third countries. We transfer your personal data to third countries in connection with the use of tools utilizing resources located in third countries, in particular in the USA.

Providers of these tools guarantee an adequate level of personal data protection through appropriate compliance mechanisms provided for by the GDPR, in particular through the use of standard contractual clauses. Currently, your personal data is transferred to third countries in connection with our use of the following solutions:

11. Do we use profiling?

We do not make decisions concerning you based solely on automated processing, including profiling, which would produce legal effects concerning you or similarly significantly affect you. Yes, we use tools within which we can take certain actions depending on information collected through tracking mechanisms, but we believe that these actions do not have a significant impact on you, because they do not differentiate your situation as a customer, do not affect the terms of the contract you can enter into, etc.

Using specific tools, we can, for example, direct personalized advertisements to you based on previous actions taken by you within a given site or suggest products that may interest you. We are talking here about so-called behavioral advertising. We encourage you to deepen your knowledge about behavioral advertising, in particular regarding issues related to privacy. 12. What rights do you have?

The GDPR grants you the following potential rights related to the processing of your personal data:

  • the right to access your data and receive a copy of it;
  • the right to rectify (correct) your data;
  • the right to erasure of data (if you believe there are no grounds for us to process your data, you can request that we delete it);
  • the right to restriction of processing (you can request that we restrict the processing of data only to its storage or the performance of actions agreed with you, if in your opinion we have incorrect data or we process it without grounds);
  • the right to object to the processing of data (you have the right to object to the processing of data on the basis of legitimate interest; you should indicate the particular situation which in your opinion justifies the cessation of processing covered by the objection; we will cease processing your data for these purposes unless we demonstrate that the grounds for processing the data override your rights or that your data is necessary to establish, pursue or defend claims);
  • the right to data portability (you have the right to receive in a structured, commonly used machine-readable format the personal data you have provided on the basis of a contract or your consent; you can request that this data be sent directly to another entity);
  • the right to withdraw consent to the processing of personal data, if you have previously given such consent;
  • the right to lodge a complaint with a supervisory authority (if you find that we process data unlawfully, you can file a complaint in this matter with the President of the Personal Data Protection Office or another competent supervisory authority).

The principles related to the implementation of the rights indicated above are described in detail in Articles 16–21 of the GDPR. We encourage you to read these provisions. For our part, we consider it necessary to explain to you that the rights indicated above are not absolute and will not be available to you in relation to all processing activities of your personal data. We emphasize that one of the rights indicated above is always available to you: if you believe that in processing your personal data we have violated the provisions on personal data protection, you have the opportunity to lodge a complaint with the supervisory authority (President of the Personal Data Protection Office).

13. Do we use cookies or other similar technologies and what does it involve?

Our website, like almost all other websites, uses cookies and other similar technologies, such as tracking codes or pixels, conversion API, etc. Using cookies or other similar technologies, certain information is collected and then used for various purposes, starting from ensuring the proper functioning of individual site functions, through analyzing user behavior on the site, to targeting targeted advertising. Cookies created in incognito mode are deleted when all windows of this mode are closed. Browser plugins are also available that allow control over cookies or similar technologies, such as Ghostery.

The option to control cookies or similar technologies can also be provided by additional software, in particular antivirus packages, etc. In addition, tools are available on the Internet that allow control over certain types of cookies or other technologies, in particular for collective management of behavioral advertising settings. We also give you the ability to control cookies or other similar technologies directly from our site.

We have implemented a special privacy mechanism that allows you to block those cookies or other technologies that you do not want. Remember that disabling or restricting the handling of cookies or other technologies may prevent the use of some functions available on our sites and cause difficulties in using the site, as well as many other websites that use cookies or other similar technologies. Cookies or other similar technologies are used to ensure the proper functioning of individual mechanisms of our sites, maintaining sessions after logging in, proper submission of forms visible on the sites, embedding video or audio players, operation of the comment system, social plugins, etc.

In addition, cookies or other similar technologies are used for the purpose of conducting statistical, analytical and marketing activities. Cookies also store information about cookie settings defined by you from the level of the privacy mechanism functioning within our site. Some cookies or other similar technologies are related to external tools that we use, and providers of these tools may gain access to information collected using these cookies or other similar technologies. Yes, we use external tools that involve collecting information about your activities on our sites. These tools are described in detail in the appendix to the Privacy Policy.

19. Do we direct targeted advertising to you?

Yes, we use external tools within which we can direct advertising to specific target groups defined based on various criteria such as age, gender, interests, profession, work, actions previously taken within our sites. These tools are described in detail in the appendix to this Privacy Policy.

20. How can you manage your privacy?

The answer to this question can be found in many places in this Privacy Policy when describing individual tools, behavioral advertising, etc. Nevertheless, for your convenience, we have collected this information again in one place. Below you will find a list of options for managing your privacy.

Yes, we may modify this Privacy Policy, in particular due to technological changes and changes in legal provisions. Appendix - List of external tools

Google Tag Manager 

We use the Google Tag Manager tool provided by the American company Google LLC, which tool is used to manage tags and load scripts within the site. Google Tag Manager as a tool itself does not collect any information beyond that which is necessary for its proper functioning, but is responsible for loading other scripts described below.

Google Analytics

We use the Google Analytics tool provided by the American company Google LLC. In order to use Google Analytics, a special Google Analytics tracking code has been implemented in the site code. The tracking code uses cookies related to the Google Analytics service. At any time you can block the Google Analytics tracking code by installing a browser add-on provided by Google.

Google Analytics automatically collects information about your activity on our site. Within Google Analytics, we have access only to Anonymous Information. Thanks to the information collected in this way, we can conduct analyses of user behavior on our website and conduct related statistics, and then draw conclusions from these statistics in order to design solutions improving the effectiveness of the site.

We use remarketing features available within the Google advertising system provided by the American company Google LLC. When visiting our website, a Google remarketing cookie is automatically placed on your device, which collects information about your activity on our site.

Thanks to the information collected in this way, we are able to display ads to you within the Google network depending on your behavior on our site. For example, if you view a product, information about this fact will be recorded by the remarketing cookie, which will allow us to direct an advertisement about that product to you or any other that we deem appropriate. This advertisement will be displayed to you within the Google network while you are using the Internet, browsing other websites, etc.

We emphasize that by using Google Ads, we use only Anonymous Information. Using Google Ads, we are only able to define audience groups that we would like our ads to reach. Based on this, Google makes the decision when and how to present our advertisement to you. If you do not want to receive personalized ads, you can manage ad settings directly on Google's side: https://adssettings.google.com/. YouTube

YouTube widgets are embedded on our sites, allowing you to play recordings available on YouTube directly from our sites. The YouTube service is operated by the American company Google LLC. When you play a recording, YouTube saves cookies on your device, including the DoubleClick cookie, and receives information that you played a recording from a specific website, even if you do not have a Google account or are not currently logged in.

If you have logged into your Google account, this service provider will be able to directly associate your visit to our site with your account. The purpose and scope of data collection as well as its further processing and use by Google, as well as the possibility of contact and your rights in this regard and the possibility of making settings ensuring the protection of your privacy are described in Google's privacy policy.

If you do not want Google to associate data collected while playing videos directly with your profile, you must log out of your account before playing the video. You can also completely prevent plugins from loading on the page by using appropriate extensions for your browser, e.g. script blocking. Information collected within cookies related to videos from YouTube embedded on our sites is used by Google to ensure the proper and secure functioning of the widget, analysis and optimization of services provided by YouTube, as well as for personalization and advertising purposes.

We do not have access to this information. For us, the only important thing is that the player works correctly. Remember that by playing recordings available on YouTube, you are using services provided electronically by Google LLC. Google LLC is an independent entity, independent of us, providing electronic services to you. Meta Pixel

We use the Meta advertising system provided by the American company Meta Platform Inc. We use the ActiveCampaign mailing system provided by the American company ActiveCampaign LLC. Mailing list subscription forms embedded on our sites may use cookie technology to ensure the proper functioning of these forms and measure their conversion.
